{"id":1827,"date":"2024-04-18T10:46:28","date_gmt":"2024-04-18T10:46:28","guid":{"rendered":"https:\/\/diplomatique.ma\/en\/?p=1827"},"modified":"2024-04-18T11:54:55","modified_gmt":"2024-04-18T11:54:55","slug":"a-judge-in-britain-rules-that-the-money-from-the-sale-of-gaddafis-palace-be-handed-over-to-the-american-arms-company","status":"publish","type":"post","link":"https:\/\/diplomatique.ma\/en\/a-judge-in-britain-rules-that-the-money-from-the-sale-of-gaddafis-palace-be-handed-over-to-the-american-arms-company\/","title":{"rendered":"A judge in Britain rules that the money from the sale of Gaddafi&#8217;s palace be handed over to the American arms company"},"content":{"rendered":"<p style=\"text-align: justify;\">A British judge has ruled that a US arms manufacturer, General Dynamics, is entitled to the proceeds from the sale of a \u00a39 million ($11.2 million) property in London, once owned by the family of late Libyan leader\u00a0Muammar Gaddafi.<\/p>\n<p style=\"text-align: justify;\">The property was at the centre of a legal battle between General Dynamics and the state of Libya, with the US firm seeking to recoup\u00a0\u00a316 million\u00a0($19.9 million) it is owed for the supply of military vehicles and communications equipment to the North African country.<\/p>\n<p style=\"text-align: justify;\">The property, once owned by Saadi Gaddafi, was seized by Libya in 2012 after a court ruled him to be the beneficial owner. General Dynamics sought arbitration from the International Chamber of Commerce, which ruled in its favour in 2016. However, Libya\u00a0appealed\u00a0to Britain\u2019s Supreme Court and won, but the US firm is pressing on with its legal moves to recover its money.<\/p>\n<p style=\"text-align: justify;\">Libya has claimed that it is exempt from legal action taken by the company because of \u201cstate immunity\u201d, but this claim was rejected by a judge at the High Court in London. The company must now apply for a court order to get the property sold so that it can recoup at least some of its money.<\/p>\n<p><b>READ:<a href=\"https:\/\/diplomatique.ma\/en\/2024\/04\/17\/un-security-council-to-vote-friday-on-palestinian-un-membership\/\">UN Security Council to vote Friday on Palestinian UN membership | diplomatic (diplomatique.ma)<\/a><\/b><\/p>\n<p style=\"text-align: justify;\">The contract between Libya and General Dynamics\u2019 British subsidiary was signed in 2008 and involved the supply of military communication equipment, years after Gaddafi abandoned his nuclear weapons and returned to mainstream international politics. The deal was for a Tactical Communication and Information System \u201cat a price in excess of \u00a384 million [$104.6 million],\u201d according to court documents.<\/p>\n<p style=\"text-align: justify;\">Tim Eaton, an expert on Libya at the Chatham House think tank, told\u00a0<i>The National<\/i>\u00a0that Gaddafi was \u201cfamed for seeing Libya\u2019s assets as his assets\u201d to use to \u201csupport patronage networks and to benefit individuals rather than bettering the situation of the Libyan people.<\/p>\n<p style=\"text-align: justify;\">\u201cIf this case comes to pass and you see assets taken by the regime going to a contractor then the Libyan people will have got nothing out of it.
