La premi\u00e8re est de savoir si les Kabyles constituent un peuple, car ce droit n&rsquo;est conf\u00e9r\u00e9 qu&rsquo;aux peuples. Le tribunal conclut que \u00ab\u00a0selon nous, ils ont ce droit\u00a0\u00bb, affirmant que \u00ab\u00a0le droit \u00e0 l&rsquo;autod\u00e9termination en droit international est un droit humain d\u00e9tenu par les peuples, comme cela est clarifi\u00e9 dans de nombreux instruments internationaux, notamment la Charte des Nations Unies\u00a0\u00bb.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">L&rsquo;avis s&rsquo;appuie sur l&rsquo;article commun premier des deux Pactes internationaux de 1966 relatifs aux droits civils et politiques et aux droits \u00e9conomiques, sociaux et culturels, stipulant que tous les peuples ont le droit \u00e0 l&rsquo;autod\u00e9termination.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Le document pr\u00e9cise qu&rsquo;il n&rsquo;existe pas de crit\u00e8res pr\u00e9cis d\u00e9finissant ce qu&rsquo;est un \u00ab\u00a0peuple\u00a0\u00bb en droit international. Cependant, plusieurs consid\u00e9rations fournissent des indices utiles. L&rsquo;un des aspects largement accept\u00e9s est que \u00ab\u00a0le peuple peut inclure une partie de la population d&rsquo;un \u00c9tat existant\u00a0\u00bb, comme l&rsquo;a d\u00e9clar\u00e9 la Cour supr\u00eame du Canada en r\u00e9f\u00e9rence aux revendications d&rsquo;ind\u00e9pendance du Qu\u00e9bec.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #000000;\">Le peuple kabyle est la plus grande communaut\u00e9 berb\u00e8re en Alg\u00e9rie, avec une unit\u00e9 linguistique, parlant un dialecte sp\u00e9cifique du berb\u00e8re.
